IMPORTANT:

G&A Compass Publishing and Training (Propriety) Limited's (registration number: 2014/230079/07) (hereinafter referred to as “G&A; “G&A Compass, “we“, “us” or “our“) is the company that runs and owns the www.gnacompass.co.za website(the “Website“). We are who you are contracting with.

By using our Website our services, or both, you must read and accept all the terms and conditions ("T&C"). By using the Website and accepting the T&C, you agree to everything in the T&C and it is as though you have read this T&C. You cannot use the Website our any services related to it if you do not agree with the T&C.

Please also see our Privacy Policy (“Privacy Policy”) for the manner in which personal information is regulated. The Privacy Policy is hereby incorporated by reference into these T&C
These T&C apply to your use of, and purchases made on, the Website.

Part 1: Purchases G&A Compass

  1. G&A Compass Products and Availability

    • Stock availability: Stocks of all goods on offer are limited and G&A Compass shall take all reasonable efforts to ensure that offers are discontinued when there is no stock available. If G&A Compass is unable to fulfill any order placed by you at the advertised price due to stock having sold out, G&A Compass will notify you and you will be entitled to a refund of the amount paid by you for such product. Please see as the “Agreements of Sale” clause below and in Refund Policy (“Refund Policy”) for all of the terms and conditions applicable to refunds and returns.
    • Errors: please note some product descriptions or photographs may not be specific to the product you wish to purchase. However, if you are dissatisfied with the product you receive, you are entitled to return the product to G&A Compass for a full refund. Please see our Refund Policy in this regard for all of the terms and conditions applicable to refunds and returns.

  2. eBooks

    For purposes of these T&C, an “eBook” means an electronic version of a printed book, in .pdf or .epub format, capable of being read on a computer using Adobe Digital Editions software (“Adobe Reader”) and on certain mobile devices "Reader Applications". Access to any purchased eBook from G&A Compass will be granted via a link to such eBook’s .acsm file (“Link”) to you.

    1. Use of eBooks:
      • All eBooks are the exclusive property of the publisher and is protected by copyright. The download of eBooks is intended for your personal use only. You may not use any eBooks purchased from G&A Compass in any other way.
      • You may not modify, publish, sell, reproduce, create derivative works from, distribute, or in any way exploit, any of the content of eBooks and more specifically copy any of the eBooks you have purchased. By downloading any eBook, you hereby acknowledge and agree to these terms. You hereby undertake that you shall not attempt to be able to take any action that is contrary to the T&C and which compromises the publisher's rights to any eBook. You hereby indemnify G&A Compass from any and all loss it may suffer or from claims which may be made by third parties against G&A Compass which arise from or in relation to your contravention of the T&C.

    2. Limits to functionality and usage of eBooks:
      • eBooks cannot be read on devices that do not support a Reader Application.
      • eBooks will only be able to be read on such device/s that are associated with your profile in such Reader Application. This means that you must register one of the Reader Applications. Please note that you will only be able to read the eBook on the device onto which it was first downloaded.
      • You will need to be connected to the internet when you download an eBook.

    3. Delivery of eBooks:
      Once payment of the relevant eBook has been or received, a Link to the relevant eBook will be delivered to your “LibraryBox” page on the Website. G&A Compass cannot control when a Link is delivered and does not undertake to make delivery within any specific timeframe. Once a Link has been delivered, you can access it anytime thereafter, however:
      • eBook publishers limit the number of times any Link can be clicked. You will be able to click on such Link at least once, but the Link may become blocked after your first click.
      • The Link will not appear if you have removed it, or G&A Compass has removed it pursuant to the G&A Compass Refund Policy.

      4. G&A Compass does not guarantee that eBook publishers will make their eBooks available for download indefinitely If the eBook or related Link is no longer available, G&A Compass accepts no liability for such. However, you may be entitled to a refund of the purchase price paid for an eBook in the event that access the Link and the eBook is not available for download. However, you will only be entitled to a refund if you report such a problem within 6 months of your receipt of the Link.

      G&A Compass is not for any service provider fees you may incur when downloading the eBook.

  3. Agreements of Sale

    G&A may remove any products added to the shopping basket or a wishlist if the purchase cycle is not completed. Only once a completed order is submitted and payment is authorised or received by G&A Compass will there be an agreement of sale.

  4. Termination, Cancellation and Blacklisting:

    • G&A Compass may blacklist you on its database to refuse to accept payment, and/or to cancel any sale concluded between you and G&A Compass (with notice to you), to prevent suspected fraud or the unfair use of promotions.
    • Please see the Refund Policy for further terms and conditions which relate to cancellations and refunds.

  5. Amounts payable by you

    1. The price of each product, or the discounted price when applicable is displayed with the product listing.
    2. Delivery charges are based on the product type, price, and weight and the delivery address as specified in the shopping basket.
    3. Value added tax at the rate of 14% is charged on goods bought by South African residents. If the shipping and billing address is international, VAT is not applicable.
    4. For delivery of products to foreign addresses, you are responsible for determining whether any import duties/levies are payable and the relevant amount.

      5. If products are erroneously offered at incorrect prices and/or delivery charges, G&A Compass will not be obliged to sell products at such incorrect prices and/or delivery charges, but shall refund monies paid by you should you not wish to proceed with the purchase at the correct price and/or delivery charge.

  6. Payment Methods

    All payments to us made be made in the following ways as set out below:
    1. Credit card payments:
      • G&A Compass may carry out certain fraud checks with the cardholder or the cardholder’s bank. Only payments where the validity of the transaction can be verified will be processed. G&A Compass is not the one collecting, storing or otherwise processing your credit card details. Instead it is PayPal, a Payment Card Industry (“PCI”) compliant payment service provider.
      • If you chose to have your credit card information stored you will be contracting with PayPal who have their own standard terms and conditions applicable to the storage of your information.
      If you chose to have your credit card information stored you will also be agreeing that G&A Compass may disclose (by means of a link between the Website and the systems of PayPal to PayPal, some of your information so that PayPal may effectively store your information in accordance with their standard terms and conditions.

    2. Bank deposits and Electronic Funds Transfer:

      If you select to pay via this method, you must follow all instructions provided to you and ensure that:
      • The exact amount must be paid;
      • The payment must be identified by supplying the order number and surname in the reference section of the deposit slip or on the electronic transfer;
      • No transfers may be made from ATM’s;
      • Cheque deposits are subject to a clearing period;
      • No bank deposits are accepted from outside the borders of South Africa; and
      • Your order will be cancelled if the amount due is not paid within 5 business days.

  7. Deliveries

    Delivery Charges: Please check the shopping cart pages for further details.
    Delivery Methods: Books are delivered by Fastway couriers.
    Delivery Periods:
    1. Delivery periods are only regarded as having commenced upon payment confirmation being received by G&A Compass.
    2. Delivery periods are calculated based on business days only. Saturdays, Sundays and public holidays are not taken into account in calculating delivery periods.
    3. If products with different delivery times are ordered together, the product with the longest delivery time will determine the delivery time of all the products in the order.

    Local delivery

    All G&A Compass items listed on the Website have an indication of the delivery time. However, note the following in particular, if delivery is to be made to a main centre in South Africa. “Main centres” include any destination within a 50km radius of the following cities: Pretoria, Johannesburg, Bloemfontein, Cape Town, Durban and Pietermaritzburg. Delivery outside main centres is usually within 3 working days.

PART 2: General

Note that this Part 2 applies to all purchases made on the Website.

  1. Sales Records

    You will only be able to view and print any transaction records with G&A for 12 months prior to the current date.

  2. Disclaimer

    Save for G&A Compass being liable to you–
    • under the Consumer Protection Act 68 of 2008 (“CPA”) in relation to any products sold by G&A Compass to you via the Website; and
    • under sections 43(5) and 43(6) of the ECT Act in relation to G&A Compass’s payment systems not being sufficiently secure,
    neither G&A Compass nor any of its agents or representatives shall be liable for any loss or liability of whatsoever nature arising from the use or inability to use this Website or the services or content provided from and through this Website. Furthermore, G&A Compass makes no representations or warranties that, amongst others, the content and technology available from this Website are free from errors or that the service will be 100% error free. You are encouraged to report any possible malfunctions and errors to www.GnACompass.co.za
    Although the products sold via the Website may be under warranty, the Website itself is supplied on an “as is” basis and has not been compiled or supplied to meet your individual requirements.

  4. Governing Law and Jurisdiction

    This Website is hosted, controlled and operated from the Republic of South Africa and governed by South African law and, subject to the ‘Disputes’ clause of these T&C, you and G&A Compass submit to the non-exclusive jurisdiction of the High Court of South Africa, Gauteng Division, Johannesburg.

  5. Privacy

    Please see the Privacy Policy for the manner in which personal information is regulated.

  6. Security

    You agree and warrant that your log-in name and password shall be used for your personal use only and shall not be disclosed to any third party.
    You allow G&A Compass to take all reasonable steps to ensure the integrity and security of the Website and back-office applications.
    All credit card transactions are SSL encrypted by the PayFast service. G&A Compass registration documents and registered domain name are protected by a SiteGround recommended SSL certificate.

  7. Changes to Agreement

    G&A Compass may change these T&C or any part thereof at any time and will endeavour to notify you via the website of any material changes. If you do not agree with any amendments to the T&C, you cannot use the Website.

  8. Disputes

    All disputes between G&A Compass and you (except for urgent or interim relief which may be granted by a competent court) arising out of these T&C; shall be submitted to arbitration in terms of the expedited rules of the Arbitration Foundation of South Africa. The expedited arbitration rules may be downloaded from http://www.arbitration.co.za/downloads/expedited_rules.pdf.

  9. Address for Notices

    G&A Compass chooses as its address for all purposes under these T&C, whether in respect of court process, notice, or other documents or communication of whatsoever nature, the following address: Info - G&A Compass, with a copy to www.GnACompass.co.za (the sending of such copy being required in order for any notice to be validly delivered to G&A Compass).

  10. Term and Termination

    These T&C apply from the date on which they are published on the Website and continue indefinitely, as amended by G&A Compass from time to time. If the Website is no longer operational, the T&C will terminate. G&A Compass reserves the right to terminate these T&C and/or shut down the Website at any time.

  11. Copyright and Other Intellectual Property Rights

    Any and all copyright subsisting in the Website, including these T&C, vests in G&A Compass and all rights not expressly granted are reserved.
    G&A Compass does not accept any liability for illegal, defamatory or obscene content. Please report any content that may be offensive or illegal to G&A Compass.
    All the content, trademarks and data on this Website are the property of or licensed to G&A Compass and as such are protected from infringement.

  12. Electronic Communications

    When you visit the Website or send e-mails to G&A Compass, you consent to receiving communications from G&A Compass electronically and agree that all agreements, notices, disclosures and other communications sent by G&A Compass satisfy any legal requirements, including but not limited to the requirement that such communications should be “in writing”.

  13. Hyperlinks, Framing, Spiders and Crawlers

    G&A Compass does not necessarily agree with, edit or sponsor any content on web pages of hyperlinks that appear on the Website but are not from non G&A Compass sites.
    No person, business or web site may frame this site or any of the pages on this Website in any way whatsoever.
    No person, business or web site may use any technology to search and gain any information from this Website without the prior written permission of G&A Compass.
